Characteristics of Detention and Bond

  • Foreign nationals in the United States can be detained by immigration authorities for a variety of reasons. Usually these involve a violation of the conditions of their visa or criminal activity.
  • Detention typically occurs when the foreign national has returned from a trip abroad or when the foreign national comes into contact with Immigration and Customs Enforcement (“ICE”) or local law enforcement.
  • If the foreign national is not (for any one of a variety of reasons) subject to mandatory detention, and is not arriving to the US for the first time, the foreign national will be eligible for a bond. A bond amount will then be set. If the foreign national pays this bond, they are released until their hearing.
