INA 245(i) Grandfathering

  • The concept of “grandfathering” refers to special circumstances in which old regulations may still apply.
  • Thanks to the Legal Immigration Family Equity Act (also known as LIFE), some aliens may qualify for a Green Card who might not otherwise qualify, despite how they may have entered the United States, even if they have remained in the country illegally or worked illegally.
  • Aliens may qualify if they are the beneficiary of either a Labor Certification application or immigrant visa petition filed on or before April 30, 2001.
  • It is also possible that the spouse or child of a grandfathered alien may also be grandfathered in as well.
