Characteristics of Habeas Corpus Petitions

  • In the U.S. government, there are three main branches of government. The executive branch enforces the law (e.g., police), the legislative branch writes the law (e.g., Congress), and the judicial branch interprets the law (the courts).
  • Habeas Corpus petitions are a request for the court (representing the judicial branch) to review an action taken by the executive branch.
  • In the context of immigration, Habeas Corpus petitions are a legal tool filed with the U.S. court system through which a foreign national may challenge the conditions or length of their detention.
  • Those who wish to file a Habeas Corpus petition must be in custody of some kind. Being in custody means that the foreign national is either actually detained in prison or is under an order of supervision.
